Abstract

Unsupervised and abused children are minors who are faced with deficiencies in guardianship; The lack and weakness of guardianship in these children provides the basis for their abuse; Now, the question is, what are the rulings of Imami jurisprudence in supporting these children against their mental and non-physical injuries? The purpose and philosophy of punishment in sexual and chastity crimes is to protect the family, public order and morals, prevention and deterrence of sexual assaults and protection of children against sexual assaults and abuses. In addition, when the ruler of Sharia does not consider the continuation of guardianship to be in the best interest of the child, due to the abuse of the child, he dismisses the guardian - real or by decree - and appoints another person to this position, or he himself takes charge of this position. .
